La multa podría accender a miles de millones de dólares, según The Wall Street Journal.
El fiscal general de Texas, Ken Paxton, ha presentado este lunes una demanda contra Meta, la empresa matriz de Facebook, por su presunta utilización de sistemas de reconocimiento facial para almacenar datos biométricos de usuarios sin su consentimiento.
En un comunicado de la Fiscalía de Texas, Paxton sostiene que Facebook ha estado recopilando «millones de datos biométricos», como escaneos de retina o de iris, registros de voz o huellas digitales y faciales, a través de fotos y videos que los texanos suben a plataformas como Facebook o Instagram, al tiempo que ha divulgado la información a terceros, sin destruirla en un plazo razonable y utilizándola «para su propio beneficio corporativo».
«Facebook ya no se aprovechará de los usuarios ni de sus hijos para obtener ganancias a expensas de la seguridad y del bienestar de las personas», afirma Paxton. «Este es otro ejemplo más de las prácticas comerciales engañosas de las grandes empresas tecnológicas y debe terminar. Seguiré luchando por la privacidad y seguridad de los texanos», añade.
La demanda prevé una sanción de 25.000 dólares por cada violación de la Ley de Captura o Uso de Identificadores Biométricos (CUBI), aprobada en 2009 y que exige tener el consentimiento de los usuarios antes de recopilar sus datos biométricos; así como 10.000 dólares por cada infracción de la Ley de prácticas comerciales engañosas, por lo que, según The Wall Street Journal, la suma total de la reclamación podría ascender a «miles de millones de dólares».
Por su parte, Meta considera que demanda es «infundada». «Nos defenderemos enérgicamente», aseveró un portavoz de la compañía, que el año pasado ya se vio involucrada en un litigio similar, cuando tuvo que pagar 650 millones de dólares por haber violado la privacidad de los usuarios del estado de Illinois.
